The undersigned has read this VBS Participant Liability Waiver (the “Waiver”) carefully and understands clearly and fully, either independently or with the help of others, the content of this Waiver. The undersigned hereby represents to CBC that the undersigned has the personal capacity, power, and authority to execute this Waiver for and/or on behalf of, as applicable, the undersigned, the undersigned’s child/children, and any individual for whom the undersigned serves, whether legally or practically, as a guardian (collectively, the “Undersigned”). The undersigned understands, acknowledges, and agrees that any reference to the “Undersigned” or “I” herein, unless the context indicates otherwise, shall include the undersigned, the undersigned’s child/children, and any individual for whom the undersigned serves, whether legally or practically, as a guardian:
I understand that there are inherent risks involved in any program. In consideration for, and as a condition of, CBC’s acceptance of the undersigned to participate in CBC’s Vacation Bible Study and all activities involved therein (collectively, the “VBS”), the Undersigned will be expressly assuming the full risk and legal liability and, permanently and unconditionally, waiving and releasing all claims for injuries, damages or loss which the Undersigned might sustain as a result of participating in the VBS, including but not limited to, the following:
General Activity Waiver:
The Undersigned hereby fully, permanently and unconditionally, waives, releases, and discharges CBC, its members, officers, employees, agents and volunteers from any and all claims, liabilities and costs, including but not limited to, any known and unknown injury, loss or damage to person or property that may occur during the course of the Undersigned’s involvement with ministries and activities at CBC on or off campus. The Undersigned agrees to indemnify, defend and hold harmless CBC, and its members, officers, employees, agents and volunteers, from any and all claims, liability and costs asserted by or on behalf of the Undersigned or any of our legal representatives, parents or heirs, within the scope of the release.
Medical and Dental Waiver:
I represent that none of the Undersigned has any health-related problems or concerns that would preclude or restrict participating in the VBS. In the event that I and/or any Releasing Person is injured while attending CBC ministries or activities and requires the attention of physician, dentist, or other medical personnel, I consent to any reasonable treatment as deemed necessary by such physician, dentist or other medical personnel. In the event treatment is required with a dentist, physician and/or hospital personnel who refuse to administer without my consent, I hereby authorize any staff member of CBC, or another adult leader designated by the staff, to give consent for me, and I agree to hold such person and CBC free and harmless of any claims, demands or suits for damages arising from the giving of such consent so long as the treatment is administered by, or under the supervision of, a licensed physician, dentist or medical personnel, I also acknowledge that I will ultimately be responsible for the cost of any medical or dental care should the cost of the medical or dental care not be reimbursed by the insurance provider.
Photo/Media Release
I authorize and permit that I and/or my child/children named above may be included in photographs and videos that may be used for display by Cherryville in informational and promotional publications, including the Cherryville website. I understand that no reference to the child/children will be made along side such images without my consent and that I will not receive compensation for the use of these images.
Transportation Liability Waiver
I recognize and acknowledge that CBC is neither a common carrier nor in the business of providing transportation services to the public. I further recognize and acknowledge that there are certain risks of physical injury to vehicle passengers, and I voluntarily agree to assume the full risk of any injuries, damages or loss, regardless of severity, that I may sustain as a result of participating in any and all activities connected with or associated with receiving transportation services, including, but not limited to, injuries, damages and loss arising out of negligent operation or supervision of the vehicle. I further agree to waive and relinquish all claims I may have (or accrue to me) against CBC, including its respective officials, agents, volunteers and employees.
Food and Beverage Liability Waiver
I recognize and acknowledge that CBC is not in the business of providing food and/or beverage services to the public. Any food or beverage served by CBC in connection with your participation in the VBS is served for free and none of the Undersigned is required to consume any food or beverage provided at the VBS. The undersigned further informs CBC that none of the Undersigned suffers from, or has informed CBC of, any and all food/beverage-related allergy suffered by the Undersigned. The Undersigned hereby voluntarily agrees to assume the full risk of, and, permanently and unconditionally, waives and releases CBC from all claims for injuries, damages or loss, and all liability related to the contents, preparation, and or presentation of food, prepared or purchased by CBC for the VBS.
The undersigned acknowledges and agrees that (i) this Waiver is an integral part of the Undersigned’s application to participate in the VBS, (ii) executing this Waiver by the undersigned is a condition for any Undersigned to participate in the VBS, and (iii) the Undersigned’s actual participation in the VBS is deemed as the Undersigned’s agreement to this Waiver and all its content, whether or not the undersigned executed this Waiver.
